Devito thanked the board after a motion to approve the hardship variance was approved unanimously .

You ’ ve always been gracious to me , and i appreciate that very much ,” Devito said . the board also revisited a use variance application for a groundmounted solar array for Block 1601 , Lot 38 , zone rr at 894 S . first rd . the application had to be resubmitted to the board because the property owner , Derek Valenti , did not mention the date and time of the hearing in the initial certified letter he sent out regarding the application .
Valenti is requesting a use variance for a ground-mounted solar array featuring 84 , 65-inch by 39- inch , solar modules in his backyard . it will be enclosed with a chain link fence 18 inches-tall in the front of the array and four feettall on the sides and rear . the rear will also contain a gate for entrance , according to Valenti . the ordinance states that all solar arrays in residential districts must be roof mounted , but Valenti ’ s roof is not compatible with such a structure , according to acos energy Business Development Contractor David appolonia , who appeared before the board with Valenti .
Jeanne Lewis appeared before the board to object to the use variance application on the grounds that the array would cause glare and general unsightliness from the vantage point of a wooded lot 20 feet to the right of the array that she and her husband , William ( also present at the meeting ), own and intend to build on one day .
“ We do have plans to clear that property , therefore that 84-panel array would be visible to the neighbors and the roadway . the glare from the proposed solar array would impact the proposed development of our property . Since it is positioned only 20 feet away from our property line , the glare would be directed to my property . it would be an unsightly view for us to see from our property , which is a buildable lot ,” Lewis said .
Lyons refuted the claim that glare would be an issue for Lewis , considering the back end of the array faces her block .

Lyons made a motion to approve Valenti ’ s application contingent on two amendments : that he plant a row of pine trees facing Block 1601 at his own expense in order to screen the array in the event that someone chooses to build on the adjacent lot and that he moves the array 15 feet to the left of the original planned location . the latter amendment will give neighbors more space from the array while keeping the array inside the 100-foot tree radius Valenti needs to stay within to prevent excessive shading on the array . the motion was approved unanimously . a second use variance application regarding a ground-mounted solar array was approved for Block 1706 , Lot 9 , zone rr at N . third St . Beverly Celona is seeking to install a 58-module array in her backyard that is 64 foot-long , approximately 20 foot-wide and approximately 10 foot-tall . the
