HAMMONTON — On September 22 , The Gazette received a copy of the Supreme Court of New Jersey decision with regards to the town of Hammonton and members of Hammonton Independent Fire Co . No . 2 .
According to the decision , “ A petition for certification of the judgment in A-002876-18 having been submitted to this Court , and the Court having considered the same ;
“ It is ORDERED that the petition for certification is denied , with costs .
“ WITNESS , the Honorable Stuart Rabner , Chief Justice , at Trenton , this 9th day of September , 2021 .”
The members of the company who were the plaintiffs were Joseph J . Caruso III , Joseph Caruso Jr ., William Tomasello , John H . Warren Jr . and John Michael Warren . The town was listed as the defendant .
On April 19 , the Superior Court of New Jersey Appellate Division ’ s decision was issued in the case of Independent Volunteer Fire Company and Joseph J . Caruso III , plaintiffs , and Joseph Caruso , Jr ., William Tomasello , John H . Warren Jr ., and John Michael Warren , plaintiffs-respondents , v . town of Hammonton , Defendant-Appellant .
The decision from Judges Messano , Hoffman and Suter overturned the 2018 decision that awarded the men $ 80,000 and $ 85,963.06 in attorney ’ s fees and costs , according to the appellate division decision .
Town solicitor Michael J . Malinsky represented the town and Louis M . Barbone from Jacobs & Barbone , PA represented the firemen .
Barbone submitted the petition to the Supreme Court at the end of April .
On May 9 , Malinsky wrote via email , “ I think it is highly unlikely that the New Jersey Supreme Court will grant plaintiffs ’ request for Certification to review the final Judgment of the appellate Division entered on April 19 , 2021 .”
On September 24 , Malinsky commented via email on this most recent decision .
“ The law was entirely in the Town ’ s favor . Plaintiffs had no claim against the Town for violation of the New Jersey Civil Rights Act . The Superior Court appropriately granted Summary Judgment in the Town ’ s favor on plaintiffs ’ due process claims and plaintiffs had no claim against the town under a class-of-one equal protection theory of liability . States Supreme Court decided the equal protection issue in 2008 , which decision was adopted by the New Jersey Appellate Division 2012 . The Town consistently challenged Plaintiffs and the Superior Court to cite or provide a case in New Jersey State or Federal Court that supported Plaintiffs ’ class-ofone equal protection claim . However neither the Superior Court or Plaintiffs could ever provide same . That is because all of the cases decided in the New Jersey Appellate Division and New Jersey Federal District Courts established the opposite , that New Jersey does not recognize a classof-one theory of equal protection in the context of both a volunteer or public employee . The Town made this clear in all of its arguments and the Appellate Division recognized same when it stated in its decision , ‘ Plaintiffs fail to cite a single case in which a class-of-one equal protection claim was successfully brought in the sphere of public employment , and we found none ,’” Malinksy wrote in an email to The Gazette .
Malinsky explained in an email that the plaintiffs have no further appeal options .
