PLANNING , from Page 1 property ( Block 3106 , Lot 26.01 Zone R1 on the town tax map ) on which she resides in order to create a 0.33-acre buildable lot . Smith said the applicant is seeking to subdivide the property so she can build a home on the new lot for her mother and father .
The lot ’ s frontages and area conformed with the town ’ s zoning ordinances , but Smith said the applicant would need a variance to grant relief for a framed garage on a permanent foundation that is non-compliant with the zoning ordinance ’ s setback requirements for accessory buildings .
The ordinance states that accessory structures are required to be set back by a distance that is 50 percent of the setback requirement for the principal structure . In Silipino ’ s case , the garage is 10.3 feet from the rear property line , while principal
structures in the R1 zone are required to be 30 feet from the rear property line , which means the garage needs to be 4.7 feet further from the property line in order to conform with the ordinance .
Board engineer Robert Vettese , of town engineering firm Adams , Rehmann and Heggan ( ARH ) Associates , listed various requirements for the application after all testimony was given . Vettese said the subdivision ’ s lot numbers shall agree with the lot number assessment that will be reviewed by the town tax assessor , the applicant shall receive all necessary permits for potential tree removals that may be needed on the property and when the applicant seeks a building permit for the proposed new home on the site , they shall submit a detailed lot grading plan , which will include indications of how the town ’ s sanitary sewer system is going to connect to the property , as well as the size of the water service line .
Vettese said ARH will measure the elevations of the sanitary sewer lines on Girard Lane to ensure they are able to gravityfeed out to that new lot .

structure variance relief for the rear yard setback , pursuant to the aforementioned conditions , and also on the condition that driveway aprons be constructed wherever applicable on the property in accordance with town standards and that the applicant inspects the curbing and sidewalk of the property to ensure it is safe and presents no hazards for pedestrians . The motion was made by board member Dr . Michael Hozik , seconded by board member Raymond Scipione and passed unanimously .
In other business , the board heard , but tabled , an application submitted by Gloria Santilli , who is seeking a hardship variance to allow for the installation of a ground mount solar array on her property , located at 616 N . First Rd . ( Block 1,001 , Lot 34 , Zone R2 on the town tax map ).
Santilli was represented during the application by Robert Tapp Jr ., who owns the property , as well as Infiniti Energy Services Senior Solar Consultant David Gardiner . Gardiner said the applicant is seeking to install the ground mount solar array in a residential zone as opposed to on the roof — where the zoning ordinance currently confines them — because the house is more than 120 years old and wasn ’ t structurally fit to support the array . He said the array would only have been able to offset 60 percent of the applicant ’ s energy usage if it were on the roof due to excessive shading from nearby trees .
Gardiner said the ground mount solar array is proposed to be placed in between two rows of trees behind the property and will not require the removal of any trees . He said the solar array is about 200 feet , 2.5 inches away from the front property line , about 112 feet , 9.5 inches away from the rear property line and will not create any obstructions for Santilli ’ s neighbors .
‘ It ’ s just a grassy area ; there ’ s nothing back there ... There ’ s trees in the area that are basically blocking the ground mount from view , which was a perfect area for that ground mount to actually to be located in because of visual and aesthetic purposes for the neighbors ,” Gardiner said .
The application hearing was stalled after Hozik pointed out that the property line depicted on the plans submitted by the applicant contained encroachments on to Santilli ’ s neighbor ’ s property , which Tapp Jr . said he was not aware of .
Schroeder said it would be best for the applicant and the professionals from Infiniti Energy Solutions to reassess the survey that was used to draft the plan and include it in the application at a later date .
