Hawks to benefit from Hammonton USA fundraiser
PLANNING , from Page 1 board solicitor James Schroeder . Schroeder clarified and said the ordinance being reviewed was intended to clarify the definition of a hospital pertaining to the town ’ s general ordinances for land use .
“ In order to accomplish what they ’ re trying to do , they feel like it will best serve to more clearly define what a hospital is ,” Schroeder said .
A section of the current definition , as read by Schroeder , said a hospital is partially defined as follows :
“ Any hospital licensed by the New Jersey Department of Health and Senior Services , or any successor agency thereto , which maintains and operates organized facilities and services including satellite or hospital-based , off-site , ambulatory fealties for the diagnosis , treatment or care of persons suffering from acute illness , injury or deformity in of which all diagnosis , treatment and care are administered by and performed under the direction of persons licensed to practice medicine or osteopathy in the state of New Jersey .”
Schroeder said the definition he read was added in March 2010 and that there are words within it that are antiquated or confusing , which is why it is being reviewed . “ Looking at the old language , there are a couple of words in there that are , I ’ ll say at best antiquated , and probably are not part of our common vernacular , or ones that shouldn ’ t be … I haven ’ t heard the word ‘ fealty ’ in probably 25 years , and I don ’ t think that we speak about people in terms of deformity that much anymore . So , I ’ m not real comfortable with the word nobody understands , another word that we don ’ t use anymore in our code ,” Schroeder said .
Board member Gordon Pherribo pointed out a section of the definition that uses the word “ convalescent ” in reference to the permitted facilities but said that is a term he found vague .
“‘ The typical hospital ,’ where people come in and they need to be healed and then they go home within a day or two usually … There are extenuating circumstances , but if they ’ re just coming there to convalesce initially , for how long ?” Pherribo said . Schroeder said the purpose of the review is to eliminate “ ambiguities ,” such as the one pointed out by Pherribo and that it is common practice for the language of these general ordinances to be altered as time passes , depending on how land use evolves .
“ From time to time ... you ’ ll see that these definitions … are revised from time to time . Just looking on this page , some were revised in 1989 and then again in 1997 . This [ definition in Ordinance 10 ] was revised in 2010 , 2011 , 2013 . So , as land use evolves , definitions are evolved to make sure that we ’ re up to the

Schroeder called for a motion to be made for Ordinance 10-2017 to be brought back to council with recommendations to look more closely at it and alter the language to solve issues of ambiguity .
Schroeder also said he and board secretary Patti Berenato will communicate with town solicitor Michael Malinsky regarding the ordinance .
The motion was made by Pherribo , seconded by board member
Linda Byrnes and approved unanimously with the exception of a recusal from Councilman and board member Joseph Giralo .
The Hammonton Planning Board will meet next on Wednesday , May 3 at 7 p . m .
