At present, a married person can rely on their spouse’s adultery to evidence the irretrievable breakdown of the marriage. Although not defined by statute, adultery has been defined by case law as sexual intercourse between persons of the opposite sex. Legislators have therefore had to consider how to expand the current definition of adultery so it is relevant in circumstances where sexual intercourse is more likely to occur with a person of the same sex. The government initially considered allowing case law around same sex adultery to develop over time. However, concerned about the uncertainty of relying on the courts to develop law in the area, it has instead decided to exclude same sex couples from relying on sexual intercourse with another person of the same sex to evidence the breakdown of their marriage.
