What a wild and crazy August for the Missouri marijuana industry . Missouri dispensaries were notified the first of last month by the Division of Cannabis Regulation ( DCR ) to pull more than 200 different products from store shelves and place them on hold , meaning quarantine those products to the dispensary ’ s safe . The same notification applied to manufacturers . Ultimately , the recall list grew to nearly 63,000 products / SKUs .
On August 10 , my letter to a DHSS spokesperson asked why the Missouri DCR recently required dispensaries to quarantine 100s of cannabis products ( SKUs ). I also asked her to send me any available news releases or provide information regarding this action because this is detrimental to dispensaries , manufacturers , and the thousands of medical patients and adult consumers who are denied access to said products . They have a right to understand what is happening and why said products are withheld by the State and not available for sale . Such information would also help dispel rumors spreading .
The DHSS spokesperson replied , “ DHSS has suspended operations for three facilities to investigate potential product safety concerns . All product related to these investigations has been placed on administrative hold until the product is deemed safe , remediated , or destroyed . Investigations are ongoing , so we cannot comment further at this time .”
However , behind the scenes , on August 2 , the DHSS sent an “ Order of Immediate Suspension ” to Delta Extraction , LLC , MAN000022 , Ms . Rachael Herndon , Robertsville , MO . The Order of Immediate Suspension went on to say , “ This order also serves as notice of investigation pursuant to 19 CSR 100-1.030 ( 2 )( B ) 5 . Until the Licensee receives written notice from DCR that the investigation is concluded , the Licensee must preserve all records of any type related to the subject of this investigation , including all video camera recordings and facility access controls records .” This all stemmed from “ alleged ” illegal product inversion .
Meanwhile , on August 14 , the DHSS sent a News Release stating in part , “ Missouri ’ s Division of Cannabis Regulation ( DCR ) announces product recall for manufactured products sold to dispensaries and manufacturers by infused product manufacturer , Delta Extraction , LLC , MAN000022 . Pursuant to 19 CSR 100-1.100 ( 4 )( P ), the DCR may issue a public notice of recall where marijuana product presents a potential threat to health and safety . No adverse reactions for this product have been reported to the DCR at this time .
“ The recalled products were not compliantly tracked in the statewide track and trace system , METRC , to allow the DCR to verify that the products came from marijuana grown in Missouri or that the product passed required testing prior to being sold at dispensaries . The list of recalled products is located at www . Cannabis . Mo . Gov .”
The recall list includes 62,800 recalled products . An industry insider told us the recalled products could be valued as high as $ 50 million . That ’ s obviously damaging industry-wide , as it will affect losses for numerous dispensaries and manufacturers across the state .
The madness continues . On August 16 , missouriindependent . com reported , “ A company [ Delta Extraction ] is accused of bringing illegal marijuana product into the Missouri market and obstructing the state ’ s investigation by staging a robbery at its facility .”
The article went on to explain the “ Red Flags ” associated with the obstruction accusation , “ On Aug . 7 , the cannabis division was supposed to visit Delta Extraction ’ s facility , but the company asked investigators to postpone it to the next day . That night , the company notified the state that someone had broken into the facility and stolen their security equipment .
