Unregulated Cannabis Products Embargo

If you ’ ve followed the news for the last few months , you may be aware of Governor Parson ’ s Executive Order 24-10 aimed at combating the sale of dangerous unregulated psychoactive cannabis products beginning September 1 , which he announced at his August 1 press conference . However , on August 21 , Missouri Secretary of State Jay Ashcroft rejected Parson ’ s Executive Order , which would have banned the sale of “ unregulated psychoactive cannabis products ” and upended the state ’ s hemp industry . The Order also directed the Department of Health and Senior Services ( DHSS ) to classify unregulated psychoactive cannabis products as unapproved beginning September 1 . This was the second time that Ashcroft nixed emergency rules regarding hemp-derived cannabis products put forth by the Governor ’ s office , which may delay the effective date of the Order by six to eight months . The Secretary of State said Parson ’ s office did not provide the required legal justification for the emergency rule .

In response , Parson held another press conference on September 10 to further enforce Executive Order 24-10 , saying that with the help of the Attorney General ’ s Office ( AGO ), the Missouri Division of Alcohol and Tobacco Control ( ATC ), and the DHSS , a joint task force will combat the sale of unregulated psychoactive cannabis products deceptively marketed to children in Missouri .
Ultimately , under Executive Order 24-10 , Governor Parson directed the ATC to file an emergency rule to amend its regulations to prohibit unregulated psychoactive cannabis products from being sold at liquor-licensed facilities ( businesses holding liquor licenses –– gas stations , convenience stores , etc .). The state provided photo examples of unregulated intoxicating ( like Delta 8 ) candies that resemble Life Savers , Mike and Ikes , Airheads , and others . The packaging of the intoxicating candies , for the most part , mimic regular , uninfused candy . The DHSS and ATC will continue to embargo unregulated psychoactive cannabis food products being sold , manufactured , or delivered in Missouri that do not originate from an “ approved source ” according to state and federal law . However , there is no “ approved source ” currently . Perhaps the state could work with reputable sources like the Missouri Hemp Trade Association , a non-profit organization , to determine an “ approved source .”
The “ embargoed ” products sold by unregulated retailers most likely do not come from Missouri sources and could come from anywhere , such as California , Mexico , or even countries like China . Many of the packaging photo examples offered by the state of these candies do not even list where they are manufactured . Additionally , there is no ingredient labeling or way of knowing what is in them .
Bottom line : consumers should never , never , ever buy cannabis-related products outside of a state-licensed cannabis dispensary . Products sold at licensed dispensaries are strictly state-regulated and undergo stringent testing before being sold to consumers ages 21 and above . Consumers should also know that state law requires you to keep / store all cannabis products locked up and completely out of the reach of minors . You alone are responsible for every child within your home / property and what they can access .
The same goes for CBD-related products ; do not buy from gas stations or the like . Find reputable CBD stores , of which there are plenty in Missouri , that list complete laboratory test results about their products on their website or in-store and clearly list ingredients on the packaging .
