Understanding Legalization Measures
Drug Testing in the Workplace
Similar to expungement , if cannabis is legal in a state , workers should not be routinely tested or pre-tested for cannabis in the workplace . As of 2020 , Maine and Nevada are the only states to extend employment anti-discrimination protections to adult-use cannabis users in addition to qualifying medical users .
● The Maine law states that “ A school , employer or landlord may not refuse to enroll or employ or lease to or otherwise penalize a person 21 years of age or older solely for that person ’ s consuming marijuana outside of the school ’ s , employer ’ s or landlord ’ s property .”
● Nevada ’ s law prohibits employers from rejecting job applicants who test positive for cannabis in a pre-employment drug screening ( regardless of whether the applicant uses the drug for medical or recreational purposes ). As with other such laws , Nevada ’ s statute exempts emergency medical workers , firefighters , and other positions where public safety is concerned .
● New York City , meanwhile , became the first city to ban marijuana testing of job applicants in 2019 , with the usual exceptions for safety-sensitive positions or where federal regulations require such testing .
● This issue has only been addressed in a very limited way , considering how many states have actually legalized cannabis at this point . Another space where Missouri could be a leader with its regulations and rules ! Another point to consider when reviewing which measure to support .
Regardless of where you land on the initiative issues briefly outlined here , the most important thing to keep in mind is that — you have a choice and that it matters ! The best thing you can do is keep yourself as educated and up to date as possible , ask questions , talk with others about your thoughts and exchange what you ’ ve learned .
