Protecting public ’ s confidential information is attorney ’ s responsibility
The Sarasota Clerk of the Court has been examining filings in small claims and civil cases for compliance since the amendment to the Fla . R . Gen . Prac . & Jud . Admin . 2.420 came into effect on July 1 , 2021 . While many Sarasota attorneys are in compliance , several attorneys locally and from other counties filing court documents in Sarasota fail to redact confidential information or correctly complete a Notice of Confidential Information within Court

Filing when filing in small claims county court civil , and circuit court civil cases .
Of all filings in the applicable Sarasota County cases from July 1 , 2021 , to the present , over 80 percent were non-compliant with Rule 2.420 . Of those filings that were non-compliant , over 80 percent were due to the filer not specifying the location ( s ) of the confidential information within the document . Additionally , we noticed that attorneys often do not file any Notice of Confidential Information within Court Filing when the document or attachments contain partial account numbers or social security numbers . Rule 2.420 ( d )( 1 )( B )( iii ) requires that account numbers and social security numbers are kept confidential .
Fla . R . Gen . Prac . & Jud . Admin . Rule 2.425 ( a ) ( 3 ) prohibits any portion of an account number or social security number from being included in a court filing . If an account number or social security number fell into an articulated exception of Rule 2.425 that means it could be included in the court filing , but it does not exempt the filer from compliance with Rule 2.420 . Rule 2.425 states : “… does not affect the application of constitutional provisions , statutes , or rules of court regarding confidential information or access to public information .” Fla . R . Gen . Prac . & Jud . Admin . 2.425 ( e ).
It is important to remember that filers are solely responsible for identifying confidential information in these court documents , including any attachments , and non-compliance may result in personal data being released to the public .
