Don ’ t Bail on Reading This : Bail Bond Action A . O . 2022.17-3

On November 28 , Chief Judge Charles E . Roberts signed Administrative Order 2022.17-3 , governing the local administration of bail bond actions . This Administrative Order aims to create a streamlined process for various bail bond matters for parties to a bail bond action , the Court , and the Clerks of the Twelfth Judicial Circuit . Although it is well known that bail bonds allow criminal defendants who are arrested and charged with a crime to secure release from jail while awaiting a court date , there are numerous scenarios that can occur once a bond is posted . Accordingly , it is important for attorneys to familiarize themselves with the Administrative Order as it addresses many of these scenarios and provides guidelines concerning bonds in accordance with Chapter 903 , Florida Statutes .

Administrative Order 2022.17-3 deals with various issues concerning criminal bail bonds including , among other things , proof of payment of transportation expenses , surrender of defendants prior to forfeiture , exoneration of bondsman prior to forfeiture , discharge of forfeitures , setting aside forfeitures , cancellation , change in charges , expiration , revocation , return of cash bond , remission , and post-judgment proceedings . Moreover , the Administrative Order includes new form templates for Affidavit of Costs on Bond Forfeitures for surety or bond agents , a Sheriff ’ s Affirmation pursuant to s . 903.26 ( 8 ), Florida Statutes , as well as a form Order Quashing Capias .
The Administrative Order serves to simplify bail bond action procedures and make them consistent throughout the Twelfth Judicial Circuit , while still accomplishing the purposes inherent in Chapter 903 , Florida Statutes .
