Knowing the definition of these legal
terms can help you with your research
Archaic language records
are sometimes difficult to
read primarily because they
were written by hand; however,
much of the terminology
cited in deeds, wills and
records have changed little
over the generations.
I thought it might be a
good idea to learn a few
legal terms when working
with official records. Here
are some of the more common
legal terms and usages.
Administrator: a person
appointed by the court
to settle the estate of a
deceased person who has
died without leaving a valid
will.
Affidavit: a signed written
statement sworn before a
notary or other court officer.
Assignee: one to whom
some right, privilege or
property is signed over by
the courts.
Bequest: commonly to
denote a gift of real estate
by will.
Bounty land: given by
the government to induce
men to enter military service,
usually consistently

Bounty Land Warrant:
a gift of land given to a person
for military service.
Collateral ancestor: an
ancestor not in direct line
of ascent but of the same
ancestral stock as a brother

Consanguinity: relation
by blood or descended from
a common ancestor.
Decedent: a deceased
person.
Deed: a formal written
instrument signed, sealed
and delivered according to
law and conveying title to
real estate.
Deposition: a testimony
of a witness in writing and
authenticated, given in the
course of a legal proceeding.
Descendant: one who
is descended, however
remotely, from another.
Dower: the legal right of
a wife to use or own some
portion of a husband’s estate
if she survives him.
Estate: the property of a
deceased person.
Executor: a person
named in a will and appointed
by a court to carry out the
provisions of a will.
Heir: a person who by
descent by right of relationship
inherits an estate upon
the death of an ancestor.
Holographic will: a will
entirely in the handwriting
of the testator.
Indenture: any deed,
written contract or sealed
statement or a contract
by which a person such
as an apprentice is bound
over for service between a
group of bondholders and
the debtor as terms of the
debt.
Intestate: a person who
has died without having
a valid will or otherwise
disposed of his real and personal
property.
Lineal descendant: a
person in the direct line of
descent.
Nuncupative will:
an oral or unwritten will
declared by the testator in
his last sickness and in the
presence of witnesses and
later reduced to writing by
someone other than the testator.
Primogeniture: a condition
of being the first-born
child of the same parents or
the right of inheritance by
the eldest son.
Probate: the process of
proving a will.
Trustee: a person to
whom another’s property or
the management of another’s
property is given in a
trust.
Testate: having made or
left a valid will.
Testator: a man who
died leaving a valid will.
Testatrix: feminine form
of testator.
Will: the legal document
containing the statement of
a person’s wishes regarding
the disposal of his/her property
after his/her death.
‘American Pickers’ returning to Ohio
Mike Wolfe, Frank Fritz and their

series, “American Pickers,” throughout

“American Pickers” is a documentary
series that explores the world of
antique “picking” on history. The hit
show follows Wolfe and Fritz, two of
the most skilled pickers in the business,
as they hunt for America’s most
valuable antiques. They are always
excited to find sizeable, unique collections
and learn the interesting stories
behind them.
As they hit the back roads from
coast to coast, Wolfe and Fritz are on
a mission to recycle and rescue forgotten
relics. Along the way the pickers
want to meet characters with remarkable
and exceptional items. The pair
hopes to give historically significant
objects a new lease on life while learning
a thing or two about America’s
past along the way.
Wolfe and Fritz have seen a lot
of rusty gold over the years and are
always looking to discover something
they’ve never seen before.
They are ready to find extraordinary
items and hear fascinating tales
about them.
“American Pickers” is looking for
