Meet Bower Bailey's Kate GitshamBUILDING BUSINESS GROWTH
Kate is one of Bower Bailey Solicitors most recent recruits, having joined the
private client team in the Swindon office this March. She has worked in law since
2007, starting out as an office junior before embarking on her legal exams through the
Chartered Institute of Legal Executives. Kate’s passion is private client work and for the
past five years she’s worked as a fee earner in the busy private client team of another
regional firm. We met Kate to find out more about her and her work.In the last 12 months, £1,211,055 worth of business has
been passed between members of Business Growth Group.
How did you get into law?
Many years ago I had my first job after
university as an office junior in a law firm,
the rest is history!
What do you love most about your job?
The majority of people need a lawyer as they
are experiencing a problem of one sort or
another at a stressful or difficult period of
their life. The ability to help them and guide
them through their difficulties and see them
come out the other side is what I love most
about the job.
What have you been working on since
joining Bower Bailey?
I have been working on a Drop-in Legal
Surgery which I will be launching soon at
the Swindon office. This will enable clients
to come and see me on an informal basis,
so I can provide them with information about
Wills, Lasting Powers of Attorney or probate
matters. There will be more details available
on our website shortly so keep an eye out.
Why is it important to have a professional
Will drawn up?
A Will is one of the most important
legal documents you will make in your
life, it deserves time, consideration and
professional advice. There are certain rules
which dictate how your property and assets
will be divided should you die without leaving
a Will and these may not reflect how you
wish your money and other possessions to
be distributed.
What are the pitfalls of a DIY Will?
The most common pitfall is that DIY Wills
are more likely to have been signed and
witnessed incorrectly, therefore meaning
the entire Will is invalid. If the Will is invalid,
your chosen beneficiaries may not inherit
and your estate will be divided as per the
intestacy rules.
A further pitfall is that DIY Wills are more
often than not poorly drafted which can lead
to adverse inheritance tax consequences for
your estate and even lengthy and expensive
litigation. Many estates can be eaten up by
the legal fees incurred in trying to put things
right.
A high level of trust and close working relationships across the whole group and within sector specific sub-groups is key to this success, with the

What is a Life Interest Trust? Why is it a
good idea to have one?
These trusts are set up during your lifetime
or on your death via your Will. They give your
beneficiary a right to enjoy the income of
the trust property, but reserve the capital
element of the trust property for someone
else.
A Life Interest Trust can be beneficial if
you are concerned, for example, about future
care home fees or if you have children from a
previous marriage.

Jason Parmley, a building contractor based in Edington, has over 30
years’ experience working on a multitude of projects. Jason and his
team lead on project plans and ideation right through to construction
and sign off, working alongside architects and building control.
The construction industry was impacted significantly during
the Covid-19 pandemic, as many industries were, with demand
outweighing supply on both materials and skills. As we start to
build back post-pandemic, Jason tells us there should always be

“I’m also often (too often!) asked if a job can be done cheaper and
of course it can. You’ll always find someone to provide a lower price
but be mindful that some building contractors don’t quote to the
specification provided. Once they’ve secured the contract they’ll start
adding on extras as they go along, meaning the cost will rise and
you’re in a situation you can’t get out of affordably. So be aware and
ask for a full itemisation and costing for the entire project spec.”
