Changes to paternity leave legislation

Did you know that paternity leave legislation is changing ?

Following a period of consultation on the current legislation , the UK Government has now published a draft Statutory Instrument , the Paternity Leave ( Amendment ) Regulations 2024 . The draft regulations make amendments to the requirements relating to notice and evidence , the period within which paternity leave can be taken and changes to the current requirement to take paternity leave in one period .
The amendments include the following :
• An employee will be able to take either two non-consecutive weeks ’ paternity leave or a single period of either one week or two weeks leave .
• The period in which paternity leave must be taken will be extended to 52 weeks after the birth of the child .
• The length of notice required has been reduced from 15 weeks before the expected week of childbirth , to 28 days prior to each period of paternity leave . This aims to facilitate better planning for both employers and employees .
It is anticipated that the changes will take effect in relation to children whose expected week of birth is after 6th April 2024 and children whose expected date of placement of adoption is on or after that date .
These changes aim to enhance family friendly workplace policies and reshape and improve paternity leave rights for employees .
