Dispute and Transactional Privilege Issues for In-House Counsel Virtual CLE

O n January 17 , 2023 , the Atlanta Bar Association hosted a webinar , “ Dispute and Transactional Privilege Issues for In-House Counsel .” On the panel were Liza Akins ( ARCO Design / Build ), Alex Bartko ( Pep Boys ), Timothy Fitzmaurice ( Alston & Bird ), Adam Gajadharsingh ( Google ), and Tiffany Moore ( Mercedes-Benz USA ). The panel was moderated by Rebecca Woods ( Seyfarth Shaw ).

In this CLE , we had in-house counsel discuss issues related to privilege considerations for in-house counsel generally , including how in-house counsel go about protecting work product and attorney-client communications with their business partners , whether for disputes or transactional work . We explored how privilege varies among jurisdictions and how multi-state companies can protect their privilege claims . We discussed how to distinguish highly sensitive , unprotected business communications from communications specifically protected under privilege . Inhouse counsel themselves wear many hats , business and legal , and managing their own communications and those of their nonlawyer business partners can be challenging . Finally , we discussed the recent appeal to the U . S . Supreme Court directed to the proper approach to protecting dual-purpose communications , including the different approaches and recommendations for how in-house counsel can optimize protection of the privilege .
