On December 6 , an outstanding group of panelists and speakers kicked off the “ But You Said You ’ re a Lawyer ” CLE series with a panel discussion on How to Review Employment and Separation Agreements / Restrictive Covenants . Kana Caplan with the firm of Krevolin & Horst provided timely updates on the current status of the enforceability of restrictive covenants in light of changes in both state law and the Federal Trade Commission ’ s proposed rules which may potentially ban non-competes . Panelist Sara Hamilton , Associate General Counsel , UPS , presented practical tips in determining when covenants , protections and agreements may be needed , and alternatives to protecting the company and balancing the risks .
Panelist Jerico Phillips , Business Counsel , Graphic Packaging International , focused on non-legal risks a company could experience , with a special emphasis on data considerations . Jerico provided practical tips and tools companies can use to help mitigate some of the data risks associated with employees holding important and sensitive data .
All the panelists presented practical drafting tips on how best to structure an employment agreement , alternatives to consider , and the challenges associated with balancing and mitigating risks in this rapidly changing legal and regulatory environment .
