in Bismarck , provided a litigation update focusing on the status of the Missouri River and Lake Sakakawea ’ s mineral issues . The presentation considered the legal principles relating to ownership rights under meandering navigable rivers and other water bodies and an update on the status of litigation in state and federal courts following the adoption of North Dakota Century Code Chapter 61-33.1 by the legislature in 2017 .
Joshua Swanson , an attorney at Vogel Law Firm in Fargo , examined the legal landscape in North Dakota relating to pore space ownership rights . Interestingly , he pointed out the potential to use such subsurface spaces for storing CO2 or saltwater waste generated from oil and gas exploration and production presents a dichotomy between competing market players with differing interests – namely , in-state surface owners versus out-ofstate interests looking to use North Dakota land to their benefit at the lowest cost . Lastly , Paul Forster , an attorney at Crowley Fleck PLLP in Bismarck , presented an update on cases and judicial decisions in North Dakota pertaining to oil and gas royalties and pooling issues .
