This drug case involved a question of whether a warrantless search and seizure of a person ’ s home was unreasonable , and thus , unconstitutional . The Supreme Court held that while such a search is not unreasonable , if it falls under one of the exceptions to the warrant requirement , when no exception exists , any evidence seized is inadmissible under the exclusionary rule and must be suppressed .

In this oil and gas dispute , the Supreme Court held , among other things , that standing is the concept used to determine whether a party is sufficiently affected to ensure a justiciable controversy exists . The Supreme Court also stated when the district court ’ s rationale for a decision is unclear , remand is appropriate .
Kaspari v . Kaspari , 2021 ND 63 . Filed 4-5-21 .
In the always harmonious world of spousal support litigation , the Supreme Court held a district court judgment ordering a former spouse to pay the other former spouse permanent spousal support
until the latter ’ s death or remarriage violated N . D . C . C . § 14-05- 24.1 ( 1 ), which allows a court to require one party to pay spousal support to the other only for a limited period of time . The Supreme Court held the district court ’ s judgment ordered spousal support for an unlimited period of time in violation of the statute , and therefore vacated that part of the judgment and remanded the case back to the district court to reconsider the issue of spousal support in light of the Supreme Court ’ s Opinion .
Michael J . Morley received his juris doctor with distinction and was admitted to the Order of the Coif upon graduation from the University of North Dakota School of Law in 1979 . That same year , he was admitted to practice law in North Dakota State Courts and the United States District Courts for the District of North Dakota . In 1981 , he was admitted in the Minnesota State Courts and the United States District Court for the District of Minnesota , as well as the United States Court of Appeals for the Eighth Circuit .
