The investing entity can be an individual , company , foreign institutional investor , foreign venture capital investors , foreign trust , private equity fund , pension / provident fund , sovereign wealth fund , partnership / proprietorship firm , financial institution , non-resident Indians / person of Indian origin , others , etc .
Q . 7 How does government allow foreign investment in ESDM sector
Foreign direct investment in an Indian company is considered under two routes :
The Indian company having received FDI either under the automatic route or the government route is required to comply with provisions of the FDI policy including reporting the FDI to
Automatic Route
Under this route no Central government permission is required .
Manufacturing of most of the electronics items are allowed under the automatic route
Indian Company

Citizens / entities from Pakistan and Bangladesh can invest in an Indian company only through the government route . In addition , an entity / citizen from Pakistan cannot invest in defence , space and atomic energy sectors .
Reserve Bank of India Route ( RBI Route )
Where principal business of the foreign entity falls under sectors where 100 % ( FDI ) is permissible under the automatic route
Government Route
For manufacturing of defence electronics and brownfield medical devices .
Under this route applications are considered by the Foreign Investment Promotion Board ( FIPB ). Approval from cabinet Committee on Security is required for more than 26 % FDI defense . The proposal involving investments of more than INR 12 billion are considered by Cabinet committee on economic affairs .
Foreign Entity : Liaison / Branch / Project Office
Government Route
Where principal business of foreign entity falls under the sectors where 100 % FDI is not allowed under the automatic route or nonprofit organizations / nongovernment organizations / government
General Permission ( Automatic Route )
General permission has been provided to project and branch office satisfying the conditions .
