A Bergen County jury recently awarded the sum to Mario Zaburski, who claimed he was standing at the par-3 ninth hole during a business outing in July 2015 when a golf cart driven by Jerome Klein struck him unexpect- edly. Following a four-day trial in July, Klein was ordered to pay Zaburski $1 million for pain and suffering, plus an additional $150,000 for future medical expenses and $2.5 million for lost wages. Zaburski filed suit against Klein in April 2017 for his “disregard for the safety of others” by driving the cart in a “careless and reckless” manner, according to court documents. The injuries Zaburski reportedly suffered had aggravated a pre-existing condition, which Zaburski’s attorney could not be reached. Klein’s attorney did not return calls for com- ment. But in court documents, Klein denied responsibility for the crash, claiming that Zaburski “saw the peril” and “should have avoided the incident.” SEPTEMBER 2019 45
