Our panellists concluded that recognizing invasion of privacy as an actionable tort in Malaysia is crucial . They discussed both courtled development and legislative enactment as means to achieve this , acknowledging that court development alone could be timeconsuming . However , they also recognised that the process of bringing the right case to the apex court could be lengthy and costly . Despite differing views on the approach , there was a unanimous call for invasion of privacy to be recognised as an actionable independent tort . p 45
