Saint Olave’s Law Society Journal LAW AND CRIMINAL JUSTICE SRISHTI SURESH Historically, the law has drawn its roots from a variety of different charters, doctrines and political opinions; today, however, we categorise the source of our legal system into statutes, or laws passed by Parliament, and common law. Under this system, judges look to the resolution of previous – but similar – cases to the ones under their jurisdiction before they make an affirmed decision. These prior resolutions are referred to as judicial precedents. Whilst these remain the most common points of reference in terms of where the law comes from, some parts of the law can also be traced to specific international agreements, in which case the European Court of Justice, or even the European Court of Human Rights, will have intervened. When taking a case to court for the first time, the proceedings will be carried out in a court of first instance.
