Panameña de Derecho Marítimo ha
tenido más de 30 Juntas Directivas
ininterrumpidas, presididas por las
destacadas personalidades que aquí
presentamos en orden cronològico.
A cada una de ellas le correspon-
dió trabajar con diferentes gobiernos.

Incentives and other advantages
Since its foundation, the Panamanian Maritime Law Association has
had more than 30 uninterrupted Boards of Directors, chaired by the
outstanding personalities presented here in chronological order. Each of
them is responsible for working with different governments. From the
presidency of Demetrio Lakas to the current administration, APADEMAR
has been consistent with its contribution in the creation, updating and
improvement of laws related to the maritime industry, its development
and competitiveness. From this platform, we honor the memory of the
presidents who no longer accompany us and applaud each of those
who gave their time and professional experience to consolidate our
association.

for the registration of new Built
Vessels under Panama Flag

Law No. 25 of 2002, promoted
the registry under Panama Flag of
new Built Vessels by introducing Tax
incentives for new built vessels under
the same owner or group. With it,
the average Age of Vessels registered
under the Flag evolved and today
the average age of construction of
Vessels, under Panama Flag is of
15 years old. The increase of new
tonnage with the flagging of new
built vessels, also lead to the upgrade
of the Panama fleet, cutting with
this strategy, the substandard vessel
traditional issue, from the media.
Six years after the enactment of the
aforesaid Law, Panama enacted Law
No. 75 of 2008 another important
legislation, still in force. This Law
has allowed the Merchant Marine
of Panama to continue offering Tax
incentives, on annual basis, to Ship
Owners which represent fleets or
economic groups, proving loyalty to
the Registry.
Nowadays the Panama Registry as
an International Registry has ratified
Treaties which promotes Safety,
Security and controls Pollution. In
this order of ideas, the Registry offers
discounts or benefits to Ship Owners
based on considerations such group
of Vessels and the commitment
with the reduction of greenhouse
emissions to prevent air and sea
pollution.
Another element to keep the
Panama Flag registry number one in
numbers of Vessels and Tonnage, is
the fact that the Panama Maritime
Authority has welcomed the use
of electronic certificates on board
in accordance to the Guidelines,
adopted by the International
Maritime Organization with the
implementation of the E- Segumar
Application platform, which allows
Ship Owners and Managers to apply
online for most of their technical
certificates. This translates into a
reduction in costs and time.
Further to the above, it is
important to note that Law 27 of
2014, eliminated the requirement of
translation into Spanish of the English
Mortgage Agreement. Today, parties
may record, through their Attorneys,
an extract in Spanish of the Mortgage
expressing the essential requirements
and may or may not include the
English Mortgage in the Notarial
Deed for Public Registration. In any
case, the original English Mortgage
Agreement will remain at the Notary.
This translates into the possibility for
the parties to keep confidentiality
on their financing details and since
the translation costs of the Mortgage
Agreement has been eliminated,
there is a reduction on the Operation
costs.
More recently the enactment of
Law N° 50 of 2017 which creates
a legal regime of incentives for
Maritime Financing Entities, Maritime
Projects and other provisions, also
included exemptions and deductions
that make the Panama Registry
effective. ❱❱
