“ The expression “ delitos de odio ” is a literal translation of “ hate crimes ”, which is used in European countries and the international sphere . However , it should be understood to include all those motivated by prejudice , or more globally , by the intolerance existing in society , which is postulated as the main enemy of Human Rights , where the principles of universality and nondiscrimination of any individual are paramount . Thus , the Organization for Security and Cooperation in Europe ( OSCE ), through Decision No . 9 / 09 of its Ministerial Council on “ Combating Hate Crimes ”, points out that “ hate crimes ” not only violate human rights , but can also lead to conflict and violence on a larger scale . Hate crimes are crimes committed against people who are intentionally targeted because of a specific inherent characteristic , such as race , sexual orientation , ideology , religion , etc ., and inflict serious harm , not only physically but also emotionally .
These crimes seek to undermine the dignity of that person , which is inherent to our condition as human beings , which implies being recognised as equal by all members of society . Therefore , the seriousness of these intolerant behaviours lies in the fact that they deny that human condition , undermine the right to develop one ’ s life in peace , harmony , freedom and , therefore , undermine society ’ s commitment to pluralism and diversity ”.

The National Office for Combating Hate Crimes ( ONDOD ), created in 2018 by the Secretary of State for Security of the Ministry of Internal Affairs , “ works on the development of tools and procedures to contribute towards improving law enforcement investigation in the field of hate speech related crimes ”.

The crimenesdeodio . info project , coordinated by journalists David Bou and Miquel Ramos and with the collaboration , among others , of SOS RACISME from Valencia , is dedicated to preserving the memory of the hate crimes that resulted in deaths in the Spanish State during the period comprising 1990 and 2020 . This research led to the creation of a database compiling 101 cases with 103 fatal victims of hatred . These cases have been identified , documented and classified according to typology ( aporophobia , dysphobia , homophobia , islamophobia , ideological hatred , racism and xenophobia , Romaphobia , transphobia , far-right football violence , misogyny [ 1 ] and others ) with the aim of “ recovering the memory of fatal victims of hatred ”.
The National Office has played an active role in the four work groups from the “ Agreement to cooperate institutionally in the fight against racism , xenophobia , LGBTIphobia and other forms of intolerance ”, and has provided institutions with the “ Protocol to combat illegal hate speech on line ”. As part of its initiatives , the Office has disseminated procedural documents , including the Protocol for Law Enforcement Action in cases of hate crimes and conduct that breaches antidiscrimination laws . In addition , a good practice guide for reporting hate crimes has been developed , as well as a guide for victims of hate crimes with developmental disabilities . The ONDOD has also worked on improving the processing of information and statistics related to the fight against hate crime by making data available in a reusable format through the Crime Statistics Portal for public access .
