ARTICLE 8 HEARING AND APPEAL PROCEDURES
8 . A . INITIATION OF HEARING
8 . A . 1 . Hearing Rights : The hearing and appeal processes outlined in this Article apply to the following : ( a ) an applicant for appointment to , or a member of , the Medical Staff ; and
( b ) an applicant for appointment to , or member of , the Advanced Practice Provider Staff .
8 . A . 2 . Grounds for Hearing :
( a ) An individual is entitled to request a hearing whenever the MEC makes one of the following recommendations :
( 1 ) denial of initial appointment ; ( 2 ) denial of reappointment ; ( 3 ) revocation of appointment ; ( 4 ) denial of requested clinical privileges ; ( 5 ) revocation of clinical privileges ;
( 6 ) suspension of clinical privileges for more than 30 days ( other than precautionary suspension );
( 7 ) restriction of clinical privileges for more than 30 days , including a mandatory concurring consultation requirement , in which the consultant must approve the course of treatment in advance ; or
( 8 ) denial of reinstatement from a leave of absence if the reasons relate to professional competence or conduct .
( b ) No other recommendation or action will entitle the individual to a hearing .
( c ) If the Board makes any of these determinations , without an adverse recommendation by the MEC , an individual would be entitled to request a hearing . For ease of use , this Article refers to adverse recommendations of the MEC . When
