ARTICLE 2 QUALIFICATIONS, CONDITIONS, AND RESPONSIBILITIES
2. A. QUALIFICATIONS 2. A. 1. Threshold Eligibility Criteria:
( a) To be eligible to apply for initial appointment, reappointment, or clinical privileges, an individual must demonstrate satisfaction of all of the following threshold eligibility criteria, as applicable 1:
( 1) have a current, unrestricted license to practice in Nevada that is not subject to any restrictions, conditions, or probationary terms and have never had a license to practice in any jurisdiction denied, revoked, restricted or suspended by any state licensing agency 2. An initial appointment application may be initiated but will not be deemed complete if an applicant has applied for and is pending a current, unrestricted license to practice in Nevada; i. If at the time of reappointment, it is discovered that the current state license has conditions placed upon it, one of the following two options will be exercised:
• If previously disclosed to the Medical Staff proactively with an explanation acceptable to the Medical Staff, the applicant may request a waiver for this criteria element.
• If not previously disclosed and discovered during the credentialing process, the processing of the application will cease until the Credentialing and Privileging Chair can review the matter and decide whether a waiver request will be permitted to proceed through the normal evaluation process.
( 2) not currently be under investigation by any federal or state agency or healthcare facility for reasons related to:( i) controlled substances;( ii) illegal drugs;( iii) insurance or health care fraud( including Medicare,

Except as otherwise provided, the threshold eligibility criteria will be applicable to individuals who apply for initial appointment after the adoption of this Manual. Existing members will be grandfathered with respect to new threshold criteria; these criteria will be applied prospectively( e. g., if in the future a member’ s license is restricted that member would fail to satisfy threshold criteria and would be ineligible for continued appointment or may be subject to automatic relinquishment).

If an individual’ s license is or was restricted, suspended, or subject to probationary terms or conditions(“ restricted” or“ restriction”) as a result of a disability, as that term is defined under the Americans with Disabilities Act, the restriction, standing alone, will not render the individual ineligible for appointment, reappointment, or clinical privileges as long as there is no current restriction on the individual’ s clinical practice. The Hospital may determine that an individual is ineligible for appointment, reappointment, or clinical privileges because of a failure to meet any other threshold eligibility criteria even if the failure may relate to a disability( e. g., felony conviction which the individual claims is a result of substance abuse).
