Furthermore, if you lose the lawsuit and a
lien/judgment is recorded against the “owner” (your
LLC), you have ALL your equity tied up (in all
properties held inside the LLC) until a resolution can be
negotiated with the Plaintiff. This puts you in a terrible
negotiating position and you will likely be the big loser.
You would also likely be restricted on your ability to
transfer memberships in your LLC.
One of the benefits of getting older (and hopefully
wiser) is experience. Not only your own personal
experience, but that of your peers. Over the last 44
years of investing in rental real estate, I have seen many
investors destroyed by poor planning and bad advice
from others (professionals and nonprofessionals). The
real problem is by the time you discover you have been
given bad advice, it is too late to do anything about it.
You cannot buy fire insurance on your house when it
has already caught fire!
No one will learn to protect your assets like you
will. No one will lose sleep over setting up a good asset
protection plan to protect you and your
family...other than you! So, take the bull by the horns
and get to work.
It is my suggestion that all real estate investors put
each of their properties into separate Land Trusts (so
each is insulated from the other). This is easy to do
once you have the knowledge and forms. It is also very
cheap to do because forming a Land Trust costs
NOTHING! Zip, nada.
Why not get the “best of both worlds” and link the
great privacy benefits of a Land Trust together with the
asset protection benefits of an LLC for some dynomite
asset protection? This can easily be done by making the
beneficiary of the Land Trust your LLC.
