The answer is yes, a tenant may decide against the lease renewal provided the lease is
held as a natural person and does not exceed R2m. If this is the case they can give 20
business days’ notice at any time. However, if the tenant exercises an early termination,
then the landlord may be entitled to charge him reasonable penalties and damages (which
would usually be stipulated in the contract).
