Unprofessional Conduct
The Pennsylvania State Board of Dentistry defines unprofessional conduct as the following:
• Knowingly or negligently employing a dentist, dental hygienist, or EFDA whose license or certificate is not current, or is suspended or revoked.
• Failing to carry out supervisory responsibility with dental staff, residents or interns.
• Delegating duties to dental staff or other personnel who the dentist knows, or has reason to know, the person is not competent or is not authorized to perform.
• Withdrawing treatment after a dentist-patient relationship has been established so that the patient is unable to obtain care in a timely manner.
• Physically, sexually or verbally abusing patients.
• Sexual misconduct by a dentist or dental staff. Consent is not a defense to sexual misconduct. Exemptions include conduct between regulated practitioner and spouse or a person with whom he / she is cohabiting.
• Unnecessarily exposing patients to ionizing radiation.
• Failing to follow current infection control guidelines from the Centers for Disease Control, including failure to ensure compliance by dental office staff.
• Failing to provide necessary care to patients in a timely manner or to inform patients of the need for care.
• Failing to make available to patients, within 30 days of a request, information sufficient to enable patients to complete insurance forms.
