2012. The Competition Tribunal
will hear evidence in the cement
industry cartel case, when the
matter resumes in Pretoria.
Despite not seeking any relief
against PPC, AfriSam, or
Lafarge, the commission referred
a case of indirect price fixing and
market division to the tribunal
against NPC. PPC was granted
conditional leniency in terms
of the commission’s corporate
leniency policy, while AfriSam
settled with the commission and
paid an administrative penalty of
almost R125-million.
The Competition Tribunal
resumed hearings in late January
into allegations of cartel-like
behaviour by a group of cement
producers: Natal Portland
Cement (NPC), Pretoria
Portland Cement Company
(PPC), Lafarge Industries
South Africa (Lafarge), and
AfriSam Consortium (AfriSam).
It follows a referral by the
Competition Commission
following an investigation in
2015 that examined collusive
conduct between the cement
companies between 2008 and
