ten zu können – diese also im Wettbewerb zu
verbieten. Dazu gilt es Patente als Verbietungs-
rechte zu verstehen, hier kann man von den
Chinesen lernen. Eine wirtschaftlich wirksame
IP-Strategie muss auf die gezielte Beeinflussung
der Kundenentscheidung abzielen. Es geht
darum, den Wettbewerbern den Zugang zu
solchen kundenrelevanten Lösungen möglichst
systematisch zu blockieren. Gerade die große
Kundennähe ist für mittelständische Unterneh-
men hier ein großer Vorteil.
3. Integrierte IP-Organisation in den
Innovationsprozess
Organisation sorgt für Effizienz
Unternehmen sollten nicht das Ideal einer mög-
lichst leistungsfähigen „Patentanmeldema-
schine“ verfolgen. Einen Ressourcenwettkampf
kann der Mittelstand auf Dauer nicht gewinnen.
Die chinesische Herausforderung macht deutlich,
dass der Blickwinkel aus der Patentabteilung
heraus erweitert werden muss. Patente müssen
als Verbietungsrechte durch Marketing und Pro-
duktmanagement zur Schaffung einer eigenen
exklusiven Stellung und Preisdurchsetzung ein-
gesetzt werden.
Die chinesische Herausforderung bietet eine
enorme Chance für die deutsche mittelständi-
sche Industrie. Der Reformdruck wächst, sich um
first place. Instead, patents should be put at the
centre of a company‘s efforts to be the sole source
of key product properties for their customers –
that is to say, to ban such properties from com-
petitive exploitation. To do so, patents should be
construed as prohibition rights – this is something
we can learn from Chinese practice. To be econo-
mically efficient, the IP strategy must aim at pur-
posefully influencing customer decisions. Systema-
tically preventing the competitors from having
access to such customer-relevant solutions as far
as possible is the paramount objective. SMEs may
in particular benefit from their sharp customer
focus.

Companies should give up the ideal of fuelling a
powerful „patent application engine“. In the long
run, SMEs will fail to win a resource competition.
The Chinese Challenge leaves no doubt that com-
panies must expand their view beyond patent
department limitations. Patents must be used
as prohibition rights by marketing and product
management to attain an exclusive market posi-
tion and a means of price enforcement.
