1. Systematische Wettbewerbsüberwachung
Ein klares Bild vom Wettbewerb als Ausgangs-
punkt
Online verfügbar sind aktuell weit über 50 Mio.
Patentdokumente und jährlich werden über
1 Mio. Neue veröffentlicht, einschließlich der eng-
lischen Übersetzungen chinesischer Dokumente.
Eine systematische Wettbewerbsüberwachung
beginnt bei den eigenen Produkten und Inno-
vationen, diese müssen an der Patentliteratur
gespiegelt werden um den weltweiten Leistungs-
stand beurteilen zu können. Solche bewerteten
Informationen über die weltweiten Aktivitäten
der Wettbewerber müssen dann für die Ent-
scheidungsträger in verdichteten Reports zur
Verfügung stehen, um als Grundlage für die
eigene Innovations- und Patentstrategie ver-
wendet werden zu können. Leider werden solche
Management-Informationssysteme in der Breite
des Mittelstands noch kaum angewendet.
2. Strategisches Verbieten für exklusiven
Kundennutzen
Durch strategisches Verbieten wird Wirksamkeit
erreicht
Wer Patente ausschließlich als „Schutz“-Rechte
gegen Nachahmung technischer Erfindungen
interpretiert, reduziert den Wettbewerb auf
Imitation und fokussiert sich regelmäßig auf
technische Details, die aus Kundensicht oft kei-
nen relevanten Nutzen stiften, oder gar nicht
wahrgenommen werden. Patente sollten gezielt
1. Systematic monitoring of competitors
Start out with a clear view of your competitors
The current online database of patent documents
includes far over 50 million records. More than
1 million new records are checked in every year,
including the English translations of Chinese
documents. Systematically monitoring the com-
petitors should start with one‘s own products
and innovations which should be reflected by the
patent references in order to properly assess the
global level of performance. Following review,
such information about global competitor activi-
ties should be turned into condensed reports and
made available to decision makers who will take
them as a basis of developing their own strategic
approach to innovation and patenting. Unfor-
tunately, looking at the SMEs at large, such
management information systems are hardly
being used yet.
2. Strategic prohibition for exclusive
customer benefits
Impose strategic prohibitions to enhance
efficiency
Where patents are solely construed as „protective“
rights that shield against counterfeits of technical
inventions, competition will be reduced to imita-
tion and focus consistently on technical details
which hardly convey any customer benefit and
often remain unperceived by the customers in the
