Compliance with the Community Legislative Acquis
The adoption of harmonization legislation allows the elimination of obstacles and the establishment of common rules aimed at guaranteeing the free movement of goods/products within the EU. The requirements applicable to 85% of products are harmonized and can be consulted through the tariff classification on Access2Markets.
Principle of Mutual Recognition
For other products, whose requirements are not harmonized and are regulated only by national rules, the principle of mutual recognition applies according to which any product legally produced and marketed under the legislation of an MS must, in principle, be admitted to the market than any other MS.

Industrial Property (brand, patent, design)
It is possible to extend legal protection to other countries through European or international registrations or register directly in the desired market, with the body responsible for the protection of industrial property.
Packaging Waste
Although the adoption of new rules on packaging (short guide) is in the legislative process, at the level of the EU Internal Market, the flow of packaging and packaging waste is regulated in Directive no. 94/62/ EC, which establishes the principle of extended producer responsibility as a common rule for all MS. This consists of the producer's financial or financial and operational responsibility for the management of waste arising from their own products, and this responsibility can be assumed individually or transferred to an integrated system.
The “Green Dot” brand is one of the systems adopted in most MS for packaging waste management (see here), with other systems existing in Denmark, Finland and Italy. In MS where there is a “Green Dot” the use of the logo on packaging is voluntary, with the exception of Cyprus where it is mandatory (in Spain it is no longer mandatory at the end of 2022 with the publication of Royal Decree 1055/2022, of December 27th) .
In Greece there is mandatory registration for foreign entities that sell directly to end consumers, and a local representative must be appointed (EMPA, this website is only available in Greek, and an automatic translator can be used).
Obstacles
Despite the creation of the Single Market without borders, with the four freedoms guaranteed and the constant progress made (in terms of deepening and strengthening), and taking into account that it is a dynamic process, there are still gaps in areas where the integration has progressed more slowly, as well as several obstacles/obstacles, which hinder the smooth functioning of the Single Market (The Single Market Scoreboard | Annual Report on the Single Market 2023 | Annual Report on Monitoring the Application of EU Law).
