• The MC appoints nominated and / or selected ( on CA instruction ), and domestic subcontractors
• The employer obtains the construction permit from the Department of Labour and Employment
• The MC notifies the Dept of Labour & Employment of the commencement of the works
• The employer / CA gives possession of the site to the contractor by the stated date
Failing contracts – possible early warning signs at the tender stage : Contractor : Incomplete submission of the priced tender and other returnables Employer : If all necessary consultants are not appointed at the design stage – may result in incomplete documentation / the need to alter already finalised documentation ; insisting on appointing the ‘ lowest tenderer ’ against professional advice ; hesitating to proceed with the contractor ' s appointment ?; No early / proactive contact with the local ‘ construction mafia ’ Consultants : Poor co-ordination of ( design and ) tender documentation .
During work stage 5
• The successful tenderer has been appointed as the principal contractor ( MC ) by the Employer
• The CA issues relevant construction information to the MC ( and for issue to subcontractors )
• The MC submits specified returnables ( and the draft construction programme ) to the CA

Employer : Directly involved – accept the tender , appoint and sign contract Contractor : Involved – fully responsible for site / works until practical completion Constr . Project Manager : Actively involved in the execution of the works Principal Consultant : Generally no longer involved OH & SA agent : Watching brief during construction Principal Agent / CA : May be the same person as the Construction Project Manager
Failing contracts – possible early warning signs during the site establishment : Contractor : After award – slow to submit returnables , proof of insurance and guarantees ; Inability to obtain / provide guarantees or proof of specified insurance ?; late and / or incomplete submission of the construction programme ; proceed with limited enthusiasm / availability of construction equipment / staff ; slow identification / appointment of domestic and nominated subcontractors Employer : Slow to provide a specified payment guarantee , proof of insurance Consultants : Late provision of ‘ proper ’ construction documentation OH & SA agent : non-compliance with OH & SA-CR 14 specification / implementation of H & S safety plan PA / CA : Late issue communication / documentation matrix ; slow to respond to queries or accept the construction programme .
