The Sales Agreement - Provisions of Vendor - Land
A Sales agreement will have variations according to whether the sale of property has to do with variations such as sale of
land only or sale of building and land. And then again variations will occur if the land has to do with Industrial, Commer-
cial and or Agricultural. In this simplistic example where the sale has to do with residential land, these are usually some
of the main items the Vendor must be able to produce once the deposit is made and before the completion of sale occurs.
These can be written into the agreement and reinforces the importance of using a lawyer who understands conveyancing.
A Certificate of Assessment/Payment from the District Revenue Office showing that the Vendor is the assessed own-
er of the said Lands and that all lands and buildings taxes are paid up.
A Clearance Certificate from the Water and Sewerage Authority related to said Lands that is no more than 3
months old at the date of completion;
All necessary final approvals for the sub-division of the mother parcel out of which the said Lands comes; (where
applicable)
A letter from the Vendor confirming that the Vendor is in possession of the original duplicate Certificate of Title
registered.
Duplicate General Plans of the said property duly approved by the Direc-
tor of Surveys; OR, the registration particulars in respect of same.
Duplicate Portion Plans of the said Lands duly approved by the Director of
Surveys;
A copy of the duly executed Memorandum of Partial Discharge pending
the settlement of the loans owed.
A Statement issued by original lending agency stating the sum to be paid to
have the Memorandum of Partial Discharge registered, if any;
Any other information which the Purchasers’ Attorneys-at-Law deem rea-
sonably necessary in order to fulfil the terms of this Agreement;
