Procedural Fairness
“Procedural Fairness” means that your
experience with the trial courts is good –
regardless of the outcome.
Justice Courts and their judges handle about
85% of the trial court cases in Arizona – both
criminal and civil. Many of our defendants
and civil litigants are self-represented and
are likely inexperienced with any court
Hon. Bill Rummer procedures. So, it’s especially important
for the court staff to help these people. We
assist them through the necessary steps to prepare for and to
receive fair and balanced justice even with the county attorney,
a civil attorney or another unrepresented civil opponent. This
is called “procedural fairness”. Neither the judge nor our staff
can give legal advice but we freely give procedural advice and
refer defendants and litigants to websites that have statutes
and court rules. With the assistance of my staff, we have
created several Mayer Justice Court forms that help people
better prepare for their “Day in Court.” Every one of the court
clerks is extremely experienced and tremendously helpful.
Importantly, when you call the Mayer court you get a live
person every time.
At trial, as I’ve said in previous articles, there are no more
“Perry Mason Moments” where one side offers up evidence
that the other side is surprised by during the trial. Also, the
day of showing up at trial here with the proverbial shoebox of
documents has ended. We strictly enforce pretrial discovery
between self-represented parties – each side must present
their evidence in a pre-designated manner and format to the
other side before the pre-trial resolution settlement conference
and at trial. The court gets a copy so that I can do pre-trial
preparation. This is especially ne
