Boarding Past Medical Bills Under Joerg

Few cases in the bodily injury field have spawned more motions, memos of law, and hearings than the
Florida Supreme Court’s 2015 decision in Joerg v. State Farm. Joerg held that evidence of eligibility
for future benefits from Medicare and Medicaid, and other social legislation was inadmissible as
collateral sources. The Panel will discuss Joerg, its effect on the Thyssenkrup v. Lasky opinion, and the
impact of admissibility of medical expenses, both past and future.
