Pay Equity: An Overview for Executive Search Pay Equity | Page 2
Introduction
The introduction of the Pay Equity Legislation could have a significant impact on
the working practices of the executive search professional. The regulation seeks
to eradicate pay discrimination between genders and across protected groups by
prohibiting organizations from asking candidates or employers about salary history.
The regulations demand that individuals must be paid the same salary and benefits
for comparable or equivalent roles.
Pay Equity will be a significant issue for US firms as well as global firms with US clients
and candidates. A number of states and cities have already implemented the legislation
with more committing to the introduction of similar regulations. Organizations that
fail to comply run the risk of fines, as well as considerable damage to their reputation.
While the new regulations will require organizations to audit, evaluate and alter their
working practices accordingly, we believe that the Pay Equity Legislation also presents
opportunities for the executive search profession to help address the issue of pay
equity and further build on the values of honesty, transparency and trust on which the
profession prides itself.

implemented across certain states and cities in the US. This guide should not be taken as
a substitute for legal advice, but we hope it will provide a useful point of reference.
