SUPREME COURT ORDERS DUTCH LEADERS TO TAKE CLIMATE ACTION
The Netherlands Supreme Court has passed a landmark ruling ordering the Dutch Government to cut the countries CO2 emissions by 25 % from 1990 levels by the end of this year.
This is the first time a nation has been demanded by its courts to take action to reduce greenhouse gas emissions to tackle climate change.
The case by the Urgenda environmental group was filed in 2013 in an attempt to force the government to exceed current EU targets.
Urgenda first won their lawsuit in 2015, but after the ruling was appealed by the government, the case made its way up to the highest court in the Netherlands.
The ruling, based in part on theories of the impacts of climate change on human rights, has already inspired similar suits across Europe— including in Germany, Britain, France, Ireland, Belgium, Norway and Switzerland.
One of the nearly 900 plaintiffs in the case, Damian Rau, was 12 years old when the suit was first filed. In a statement, he called the ruling“ an example to the world that no one is powerless and everybody can make a difference.”

El caso fue admitido a trámite tras la demanda presentada por el colectivo ecologista Urgenda con el objetivo de forzar al gobierno a ir más allá de los objetivos fijados por la Unión Europea.
Urgenda ganó su primer caso en 2015 pero la apelación llevada a cabo por el gobierno obligó a llevar el caso ante la más alta instancia judicial del país neerlandés.
La sentencia, basada en parte en tesis sobre cómo impacta el cambio climático sobre los derechos humanos, ha motivado la presentación de denuncias similares en diferentes países europeos como Alemania, Reino Unido, Francia, Irlanda, Bélgica, Noruega y Suiza.
Uno de los casi 900 querellantes, Damian Rau, tenía 12 años cuando la demanda fue presentada por primera vez. Rau manifestó a través de un comunicado que la sentencia representa“ un ejemplo ante el mundo de que nadie ostenta un poder absoluto y que cualquiera puede cambiar las cosas”.
