SUPREME COURT ORDERS DUTCH LEADERS
TO TAKE CLIMATE ACTION
The Netherlands Supreme Court has passed a land-
mark ruling ordering the Dutch Government to cut
the countries CO2 emissions by 25% from 1990 le-
vels by the end of this year.
This is the first time a nation has been demanded
by its courts to take action to reduce greenhouse gas
emissions to tackle climate change.
The case by the Urgenda environmental group
was filed in 2013 in an attempt to force the govern-
ment to exceed current EU targets.
Urgenda first won their lawsuit in 2015, but af-
ter the ruling was appealed by the government, the
case made its way up to the highest court in the Ne-
therlands.
The ruling, based in part on theories of the im-
pacts of climate change on human rights, has alre-
ady inspired similar suits across Europe — inclu-
ding in Germany, Britain, France, Ireland, Belgium,
Norway and Switzerland.
One of the nearly 900 plaintiffs in the case, Da-
mian Rau, was 12 years old when the suit was first
filed. In a statement, he called the ruling “an exam-
ple to the world that no one is powerless and every-
body can make a difference.”

El caso fue admitido a trámite tras la demanda
presentada por el colectivo ecologista Urgenda con
el objetivo de forzar al gobierno a ir más allá de los
objetivos fijados por la Unión Europea.
Urgenda ganó su primer caso en 2015 pero la
apelación llevada a cabo por el gobierno obligó a
llevar el caso ante la más alta instancia judicial del
país neerlandés.
La sentencia, basada en parte en tesis sobre
cómo impacta el cambio climático sobre los de-
rechos humanos, ha motivado la presentación de
denuncias similares en diferentes países europeos
como Alemania, Reino Unido, Francia, Irlanda, Bél-
gica, Noruega y Suiza.
Uno de los casi 900 querellantes, Damian Rau,
tenía 12 años cuando la demanda fue presentada
por primera vez. Rau manifestó a través de un co-
municado que la sentencia representa “un ejemplo
ante el mundo de que nadie ostenta un poder ab-
soluto y que cualquiera puede cambiar las cosas”.

South Wales and Victoria just before the New Year.

Since last year 24 people have been killed, inclu-
ding three volunteer firefighters and more than 1500
homes have burnt to the ground.
Months of drought, record-breaking temperatu-
res, strong winds and dry thunderstorms have all
contributed to the deadly force of the fires and their
rapid spread.
In NSW several towns have been completely des-
troyed, with thousands of people ordered to prepare
for the worst and evacuate. Eerie images of Sydney
blanketed under a thick haze of toxic smog heral-
ded calls for the annual NYE firework display to be
cancelled out of respect for the thousands of people
affected.
In the state of Victoria, fires ravaged the popular
holiday town of Mallacoota, where thousands of ho-
liday makers were forced to shelter in lakes and on
beaches as the fires descended on them. Tasmania,
Queensland and South Australia have also been bad-
ly affected.
It is estimated that 8.4 million hectares, an area
the size of Scotland has burnt and it is now believed
that a billion animals have been killed since the start
of the fire season – sparking concerns that some
species haven been driven to the brink of extinction.
The extent of the fires has been such that the
sheer amount of smoke produced has travelled more
than 11,000 km, engulfing parts of New Zealand and
reaching as far as South America.
The Australian Government and current Prime
Minister, Scott Morrison have been widely scrutini-
sed for their apathy towards the cause of the fires,
denying the scientifically backed link between the
country’s current extreme weather conditions and
climate change.
The ongoing state of emergency is set to continue
across the country, with several dry summer months
ahead and no sign of the temperatures abating.

Los cálculos apuntan a que el total de tierra que-
mada alcanza los 8,4 millones de hectáreas, una
superficie equivalente a la de Escocia. Mil millones
de especies animales habrían muerto según estas
mismas estimaciones, existiendo la posibilidad de
que alguna especie haya quedado al borde de la
extinción.
Tal ha sido la magnitud del fuego que el humo
resultante ha llegado a desplazarse más de 11.000
kilómetros, cubriendo partes de Nueva Zelanda y
alcanzando zonas de América del Sur.
El gobierno australiano y el actual primer minis-
tro, Scott Morrison han sido severamente reprendi-
dos por su supuesta apatía a la hora de investigar
la causa de los fuegos y su negativa a admitir la
científicamente demostrada relación entre las con-
diciones meteorológicas del país y el cambio cli-
mático.
La situación de emergencia está llamada a se-
guir active a lo largo y ancho del país ante la expec-
tativa de varios meses de sequedad estival y sin
previsión de que bajen las temperaturas.
