RULES & REGULATIONS 2. Any dispute or claim (including but not limited to those violations or fraudulent practices outlined in 130 through 143) not satisfactorily resolved by means of AMHA disciplinary procedures, hearings, or penalties shall first enter into mediation and/or binding arbitration in accordance with AMHA guidelines prior to the initiation of any lawsuit against any member, director, officer or employee of the AMHA. Any agreement signed by the involved parties pursuant to the mediation conference shall be binding. If mediation does not result in a mutual agreement, all such disputes shall be decided by binding arbitration in accordance with AMHA guidelines. Actual cost of this process will be shared and paid equally by the parties when a mutual agreement is signed or in whole by the unsuccessful party to an arbitrator’s decision unless the arbitrator determines otherwise. By virtue of membership, all members agree to be bound by this rule. (Amended 0211, effective 01-12) 3. No legal action of any kind, whether in law or equity, will be commenced against the Association in any courts other than those federal and state courts located in Tarrant County, Texas. (Amended 02-08, effective 01-09) (Amended 02-11, effective 01-12) FEES 120 CURRENCY All fees required by the Association are to be paid in U.S. dollars. All foreign fees shall be in international money order or bank draft in U.S. dollars; all Canadian fees are to be payable in U.S. dollars. All fees may be paid by Visa, MasterCard, Discover or American Express. 121 MEDIATION/ARBITRATION DEPOSIT (See Article IV 110-2, page 40) A $5,000.00 mediation/arbitration deposit must be made at the time the claim is made. The deposit is to cover the Association’s legal cost. Any unused portion of the deposit will be returned. (Amended 02-11, effective 01-12) VIOLATIONS 130 REFUSAL TO ASSIST No person shall refuse, on reasonable request, to assist the Association, its officers, committees, or agents, in locating, identifying, and inspecting, or to answer promptly and truthfully any inquiry concerning a horse or an ancestor thereof, in his ownership or control, which has been registered, or for which application to register has been made. The above rule shall also apply equally to any issue involving violations, or suspected violations, of the Bylaws and Rules and Regulations of the Associa tion. 40
