NUCA of Florida Opposes HB 7071 & 593 and SB 686
These bills were filed in response to a 2010 Grand Jury’s report on public corruption. Initially, these bills would have expanded the definition of a “public servant” to include contractors. The construction industry objected and the bills have been revised to add “public contractor” to the definitions. The bills now targets corruption by public contractors in direct privity with a public entity and requires a determination that the contractor “knowingly and intentionally” committed an act of bribery, official misconduct (like causing public records to be falsified, altered or destroyed, concealing and covering up, etc.), or found guilty of bid tampering by altering or amending a response to a competitive solicitation.
