2017 NJ STATE PBA Collective Bargaining Seminar
wants but makes the least amount of sense. It must be the result of a traumatic event that is un-designed and unexpected. The Board of Pensions is hammering applicants over what that means.
• The event must occur as a result of regular and assigned duties, so show a badge to make it official that you’ re doing something.
• The Board will go back through your medical history to see if the disability can be blamed on something other than the accident.
• Make sure there is verbiage in your contract so Ordinary
and Accidental retirement pensions get health benefits.
• The Board will be checking on your disability. If you see an investigator following you or a strange person following you, call the police and let them know you are being stalked.
• Whatever you are doing after your disability retirement, make sure it is consistent with your disability. In other words, don’ t take a Disability Pension and then get a job as a security guard.
• Always talk to a financial person about the tax implications of your pension. d writing that anything you say during that interview cannot be used against you during the course of that investigation. They are conducting a criminal investigation, but it’ s not you they want. It has to be signed by somebody authorized to give it: the Attorney General or his or her designee, or the county prosecutor or his or her designee.
• Any penalty of five days or less is a minor discipline; five days or greater is a major. They might tell you to take a minor and that it won’ t count toward progressivity. All discipline counts toward progressivity.
• If you receive an order of forfeiture, deal with it immediately. It can wipe out your entire career because you won’ t be able to carry firearms.
• You must avoid a Final Restraining Order. A Temporary Restraining Order can be dismissed. Anything that leads to a Final Restraining Order can be a career-ending blow.
• If you are called into IA and you are the target of an administrative investigation, you want to call your PBA rep and PBA attorney. You must remove yourself from the event and let somebody else think for you.
• If you are subject to a random drug test and don’ t remember everything you might have taken, call your PBA rep and call a timeout. Go back through your accounts to remember what you’ re taking. Or have the IA rep follow you to your house and go through your medicine cabinet. You don’ t want to miss anything.
• When you are brought in for a test, always ask for a second sample. Ask for it to be preserved. It can lead to good things if that first test comes up hot. If you get on the Central Drug Registry, you’ re done.
• You can’ t refuse a drug test. If you refuse, you’ re done.
• Integrity issues are very, very important. Never, ever lie during an investigation. d
