Court punts on negotiations over health
contributions
In the October 2015 issue of NJ Cops Magazine, we
reported on a PERC decision which limited when
unions can negotiate for lower health insurance contributions under Chapter 78.The case involved the
Clementon Education Association and the Board of
Education, but the principles apply to PBAs as well. The
Association appealed PERC’s decision. The Appellate Division
recently issued its decision and essentially kicked the can down the
road. It dismissed the appeal as moot because the parties had
signed a new agreement after the appeal had been filed. The court
