Military Land Use Planning Act The Military Land Use Planning Act of 2014 is codified in Title 11 , Article 3 , Chapter 106 , Sections 11‐106‐1 through 11‐106‐5 in the Code of Alabama . The Act states that local governments should “ cooperate with military installations located within the state in order to encourage compatible land use , help prevent incompatible encroachment upon military installations , and facilitate the continued presence of major military installations within the state ”. The legislation requires local governments whose jurisdictional boundaries are within two miles of a military installation to notify affected installations of proposed land use changes and to allow installations 30 calendar days to comment on proposed land use changes and before any final action is taken or any public hearing is scheduled .
The Act was amended to add Section 11‐52‐8 of the Alabama Code , which requires municipalities to acknowledge and show military installations in any master plans and relevant maps that are adopted by municipal planning commissions .
