A developer is suing the City of
Newburgh for what it claims is a breach
of contract for a mixed-use housing
project on Broadway at Johnston
Street. Mill Street Partners is seeking
$31.5 in damages, attorney’s fees and
an undetermined amount of punitive
damages.
Mill Street has also filed a complaint
against Newburgh City Manager Michael
Ciaravino, who, it claims “completely
reversed the city’s course in violation of
its express commitments” in the project’s
development agreement.
The lawsuit stems from an agreement
signed by the city in 2012 supporting
Mill Street’s plan to construct a housing
complex with 91 affordable-apartment
units and two retail spaces, including
a 12,000-square-foot grocery store. Mill
Street claims it has spent more than $1.5
million on the project, commonly referred
to as the Mid-Broadway Project.

create permanent, low-income housing
on a valuable piece of city real estate.
City landlords Stuart Sachs and Drew
Kartiganer successfully filed a lawsuit
against the city in 2014, claiming the
PILOT would create a property-tax
burden, the project provided inadequate
parking and hadn’t received enough
oversight by the city planning board,
among other complaints. The city was
forced to invalidate a special-use permit
granted for the project.

Manley has decided to run as a candidate
for an open seat in New York’s 104 th
Assembly District. Manley is so far the
only Republican to publicly announce his
candidacy in the
race.

candidate to fill
the
position,

Manley is currently serving his first
term on the Newburgh Town Council.
