Newburgh man convicted of possessing child pornography videos
Orange County District Attorney David M. Hoovler
announced that on Thursday, Jan. 14, Miguel Vasquez,
46, of Newburgh, was found guilty of 16 counts of promoting a Sexual Performance by a Child, and 15 counts
of Possessing a Sexual Performance by a Child, following
a bench trial before Orange County Court Judge Robert
H. Freehill. Vasquez faces a maximum term of 112 years
in prison when he is sentenced on Feb. 11.
Prosecutors had argued that
between June 15, 2014 and Sept.
24, 2014, Vasquez used a file-sharing program to download fifteen
child pornography videos. He
also used the program to offer
one of the videos for others to
download. On Sept. 24, 2014, the
New York State Police executed
a search warrant at the defendant’s home at 55 Gidney Ave. in
the City of Newburgh and seized

various items of computer equipment. The State Police Computer
Crimes Unit performed a forensic analysis on a desktop
computer found in the defendant’s home and found the
child pornography videos in a folder called “My Shared
Files” located on the desktop of the computer.
After he rendered the guilty verdict, Judge Freehill
remanded Vasquez to Orange County Jail without bail.
Vasquez faces a maximum of seven years’ incarceration
for each of the sixteen counts of Promoting a Sexual

Performance by a Child and those sentences can be run
consecutively for a maximum potential sentence of 112
years, together with concurrent sentences on the possession charges.
Hoovler thanked the New York State Police for their
assistance in the investigation of the case.
“Children are the most innocent and vulnerable of
all crime victims,” said Hoovler. “Those who possess and
disseminate images or videos of children being sexually
abused constitute a grave danger to children everywhere.
Possessing and disseminating material like that encourages further abuse and exploitation of children. My office
will continue to seek lengthy prison sentences for those
who possess and disseminate such horrific images.”

Sean M. Fabre, 20, of New Windsor, was charged
Jan. 8 with aggravated unlicensed operation 3rd, speeding and tinted windows. He was arraigned before
Justice Noreen Calderin and was due in town court on
Jan. 25.
Daniel R. Sadowski, 28, of Rock Tavern, was charged
Jan. 8 on a bench warrant. He was released on $400 bail
and was due in town court on Jan. 12.
Stephanie Modungo, 31, of New Windsor, was
charged Jan. 6, with aggravated unlicensed operation 3rd, suspended registration, no/expired registration, unregistered motor vehicle, insurance violation.
Modungo was arraigned before Justice Richard Thorpe
and is due in town court on Jan. 19.
Shavon M. Williams, 37, of Newburgh, was charged
Jan. 8, with suspended registration, aggravated unlicensed operation 3rd, insurance violation unregistered motor vehicle and unsafe lane change. She was
arraigned before Justice Noreen Calderin and was due
in town court on Jan. 21.
Orville R. Angel Jr., 48, of New Windsor, was
charged Jan. 8, with aggravated unlicensed operation,
unlicensed driver, equipment violation, and speeding
in a posted zone. He was arraigned before Justice
Noreen Calderin and is due in town court on Jan. 28.
Daniel Markel, 38, of Newburgh, was charged Jan.
8 with aggravated unlicensed operation, unlicensed
driver, failure to signal, insurance violation and failure
to provide registration. He was arraigned before Town
Justice Noreen Calderin and released on $300 bail. He
was due to return to town court on Jan. 14.
Bamidele Babalola, 24, of Brooklyn, was charged
Jan. 9, with aggravated unlicensed operation, and
speeding in a posted zone. He was arraigned before
Justice Noreen Calderin and is due in town court on
Feb. 11.
Carlos A. Montosa, 27, of New Windsor, was charged
Jan. 9, with circumventing interlock device, aggravated
unlicensed operation, unlicensed driver, equipment
violation and no/expired inspection sticker. He was
arraigned before Town Justice Richard Thorpe and is
due back in town justice court on Feb. 23.
Gerard Viglianese, 55, of New Windsor, was charged
Jan. 10, with falsely reporting an incident. He was
arranged before Justice Noreen Calderin and is due in
town court on Jan. 28.
Franco Antonio Huarta of Newburgh, was charged
Jan. 11, with aggravated unlicensed operation 3rd, unlicensed driver, no/expired inspection, improper plates,
unregistered motor vehicle and insurance violation.
He was arraigned before Town Justice Richard Thorpe
and is due to return to town court on Feb. 9.
Jasmine T. Hawkins, 27, of Newburgh, was charged
Jan. 10, with aggravated unlicensed operation 3rd. She
was arraigned before Town Justice Noreen Calderin
and is due in town court on Feb. 11.
Jesse C. George, 32, of New Windsor, was charged
Jan. 10, with possession of a forged instrument and
two counts of possession of stolen property. He was
arraigned before Town Justice Noreen Calderin and
held on $5,000 bail. He was due in court on Jan. 11.
Jesse Lee Pena, 19, of Washingtonville, was charged
Jan. 10, with unlawful possession of marijuana, no/
expired inspection and equipment violation. He was
arraigned before Town Justice Noreen Calderin and is
due in town court on March 10.
Rhynyl P Redula, 29, of Monroe, was charged Jan.
10, on a bench warrant. He was arraigned before Town
Justice Noreen Calderin, held on $300 bail, and was due
in town court on Jan. 11.
