City files federal suit over PFOS

Port Authority of New York and New Jersey , which operates the airport . Other defendants include PFAS manufacturer 3M Company .
“ The lawsuit alleges that the defendants ’ manufacture , sale and use of aqueous film forming foam ( AFFF ) containing PFAS resulted in widespread contamination of Washington Lake , the city ’ s primary water supply for more than 27,000 consumers , and the watershed for the city ’ s drinking-water supply reservoirs ,” a City of Newburgh press release stated this week .
The state has purchased clean water for the city from the Catskill Aqueduct since May , 2016 . The city will draw water from Brown ’ s Pond when the aqueduct is shut down for 10 weeks of maintenance scheduled in the fall .
In the lawsuit , the city is also asking the United States District Court for the Southern District of New York to require defendants to assist in the development of a comprehensive watershed-management program and reimburse the city for costs that it incurred from the contamination .

The city expressed concern that a granular-activated carbon filtration system paid for by the state at the city water filtration plant “ is only designed to treat PFOS and

( perfluorooctanoic acid ) PFOA , and does not include a treatment plan for short-chain PFAS .”
The city claims it “ has spent more than two years asking owners and operators of the base and airport to stop using PFAS and to prevent the ongoing discharge of contaminated water , originating from the base , from flowing into the streams that feeds Washington Lake ,” to no avail .
According to the city , twelve different types of PFAS have been found in Washington Lake , including PFOS and PFOA . Unregulated at the federal level , PFAS – often referred to as perfluorinated compounds ( PFCs ) - have been associated with autoimmune disease , testicular cancer , ulcerative colitis , thyroid issues , high cholesterol and low birthweight , among other conditions .
