LEAVE-RELATED PROVISIONS
EMERGENCY FAMILY AND MEDICAL LEAVE
EXPANSION ACT (EFMLEA)
• As with current FMLA – Provides job protection
• Exemptions:
Employee working for a health care provider or an emergency responder
Employer with 25 employees or less:
• If the employee’s position has been eliminated due to economic or operating conditions caused
by a public health emergency, AND
• The employer makes reasonable efforts to reinstate to an equivalent position.
