LEAVE-RELATED PROVISIONS
EMERGENCY FAMILY AND MEDICAL LEAVE
EXPANSION ACT (EFMLEA)
• First 10 days are unpaid.
• Employees may use other paid leave to supplement those first 10 days:
Emergency Paid Sick Leave (if eligible)
Any existing accrued paid time off (vacation, personal or sick)
• An employer cannot require the usage of this leave
• Remaining 10 weeks
Eligible employees must be paid at two-thirds the employee’s regular rate or
minimum wage, whichever is greater.
Eligible employees with variable hours, leave would be equal to average of
hours work over previous six months.
Limited to: $200 a day / $10,000 total
Anything beyond limit would be unpaid for remainder of the 12-week total.
