LEAVE-RELATED PROVISIONS EMERGENCY FAMILY AND MEDICAL LEAVE EXPANSION ACT (EFMLEA) • First 10 days are unpaid. • Employees may use other paid leave to supplement those first 10 days: Emergency Paid Sick Leave (if eligible) Any existing accrued paid time off (vacation, personal or sick) • An employer cannot require the usage of this leave • Remaining 10 weeks Eligible employees must be paid at two-thirds the employee’s regular rate or minimum wage, whichever is greater. Eligible employees with variable hours, leave would be equal to average of hours work over previous six months. Limited to: $200 a day / $10,000 total Anything beyond limit would be unpaid for remainder of the 12-week total. 8
