Mr. Skiermont has substantial experience representing pharmaceutical companies in Hatch-Waxman patent litigation. For example, Mr. Skiermont represented the patent holder in Hatch-Waxman patent litigation against five generic drug manufacturers who sold or sought approval to sell generic versions of the YAZ® oral contraceptive. After two generic drug manufacturers had launched generic versions of YAZ® “at risk” of later being found to have infringed a valid and enforceable patent, the Federal District Court for the District of Nevada granted Bayer’s motions for summary judgment of validity, infringement, and enforceability against three generic drug manufacturers. On appeal, the Federal Circuit reversed and a motion for panel and en banc rehearing is pending. Mr. Skiermont has also represented clients in Lanham Act false advertising and patent infringement cases. One such case arose from the launch of a competing generic version of an oral contraceptive with product literature claiming that the generic contained a patented formulation when the product did not contain such a formulation. After moving for a temporary restraining order, the court read a tentative ruling during the proceedings finding that Mr. Skiermont’s client was entitled to a TRO. The defendant agreed to remedial measures including a weekly e-mail blast for three months directed at pharmacists correcting the false prescribing information. The court entered an order regarding these remedial measures and required compliance reporting from the generic manufacturer. Mr. Skiermont earned his undergraduate degree with honors from the University of Kentucky. While an undergraduate, he was twice awarded FIRST PLACE SPEAKER at the Intercollegiate National Debate Tournament; one of only three people to win the award twice since the Tournament began in 1947.
